II. Scope, purposes, and legal bases for processing

1. Account creation and user authentication

Purpose of processing: creation of a user account, login, authentication, and providing access to account features.

Legal basis: Article 6(1)(b) of the GDPR, i.e. processing necessary for the performance of a contract or to take steps prior to entering into a contract.

Data scope: username, e-mail address, password, and, in the case of social login, also data provided by the login provider in accordance with the scope of consent granted.

2. Login via Facebook or Google

We may enable login or registration using external accounts provided by Meta (Facebook) and Google.

Purpose of processing: facilitating registration and login to the service and simplifying the user identification process.

Legal basis: Article 6(1)(b) of the GDPR and, depending on the specific functionality, Article 6(1)(a) of the GDPR.

Data scope: depending on the user’s account settings and the scope of consent, this may include first name, profile name, e-mail address, user ID in the given login system, and other basic profile data made available by Facebook or Google.

By using social login, the user transfers certain data to Meta Platforms Ireland Limited / Meta Platforms, Inc. or Google Ireland Limited / Google LLC, in accordance with those entities’ privacy policies.

3. Use of services not requiring an account

Some features of the service do not require creating an account, e.g. browsing listings, searching content, viewing offers, or using selected informational features of the service.

Purpose of processing: provision of electronic services, ensuring proper operation of the service, security, and analysis of how the service is used.

Legal basis: Article 6(1)(b) of the GDPR and Article 6(1)(f) of the GDPR, i.e. our legitimate interest in ensuring the security, stability, and development of the service.

Data scope: activity data within the service, session data, device information, operating system, browser, approximate location, IP address, and interactions with content.

4. Use of services requiring an account

Having an active account allows use of the full functionality of the service, including managing listings, messages, packages, settlements, activity history, and other account-related features.

Purpose of processing: account administration and provision of services available after login.

Legal basis: Article 6(1)(b) of the GDPR.

Data scope: data provided by the user in the profile and data related to the use of the service’s functionalities.

5. Contact with the user, handling requests, complaints, and claims

Purpose of processing: responding to messages, handling requests, complaints, claims, and pursuing claims.

Legal basis: Article 6(1)(f) of the GDPR, and in some cases Article 6(1)(b) or (c) of the GDPR.

Data scope: data provided in the contact form, e-mail correspondence, messages within the service, and data necessary to handle the matter.

6. Marketing, traffic analysis, and ad effectiveness measurement

We may use analytics and advertising tools, including Meta Pixel, Meta remarketing tools, and Google tools, as well as other technologies used to analyze the effectiveness of advertising campaigns and tailor ads to users.

Purpose of processing: traffic analysis within the service, measurement of marketing campaign effectiveness, remarketing, personalization of marketing communication, fraud prevention, and service development.

Legal basis: Article 6(1)(a) of the GDPR, where consent is required for the use of certain marketing technologies, and in appropriate cases also Article 6(1)(f) of the GDPR.

Data scope: IP address, online identifiers, cookie identifiers, device and browser data, information about page views, clicks, visits, time spent on the page, navigation between subpages, conversion events, and other user interactions with the service.

III. Integrations with Meta and Google

1. Meta (Facebook)

Within the service, we may use tools and integrations provided by Meta, in particular:

  • Facebook login,

  • Meta Pixel,

  • Meta remarketing and analytics tools.

Data that may be processed:

  • online identifiers and cookie identifiers,

  • IP address,

  • device, operating system, and browser information,

  • user activity data in the service, such as views, clicks, visits, opening of specific pages, conversion events,

  • basic profile data transferred during Facebook login, according to the scope of user consent.

Purposes:

  • enabling Facebook login,

  • measuring ad effectiveness,

  • remarketing and serving personalized ads,

  • analyzing user activity in the service,

  • improving the service and promotional campaigns.

Processing method:
Data may be collected automatically using tracking codes, cookies, and Meta analytics and advertising tools, or provided by the user during Facebook login. To a certain extent, data may be transferred to Meta in accordance with the operation of these tools.

2. Google

Within the service, we may use tools and integrations provided by Google, in particular:

  • Google login,

  • Google remarketing and analytics tools,

  • Google advertising and measurement tools.

Data that may be processed:

  • online identifiers and cookie identifiers,

  • IP address,

  • device, operating system, and browser information,

  • user activity data in the service,

  • basic profile data transferred during Google login, according to the scope of user consent.

Purposes:

  • enabling Google login,

  • remarketing and ad targeting,

  • measuring ad campaign effectiveness,

  • analyzing traffic and user behavior,

  • developing and optimizing the service.

Processing method:
Data may be collected automatically using cookies, tags, and Google advertising and analytics tools, or provided by the user during Google login. To a certain extent, data may be transferred to Google in accordance with the operation of these services.

IV. Data recipients

Personal data may be disclosed only to the extent necessary to achieve the purposes indicated in this Privacy Policy.

Recipients of the data may include in particular:

  • hosting and IT infrastructure providers,

  • e-mail and communication service providers,

  • analytics, advertising, and marketing service providers,

  • social login tool providers,

  • security and anti-abuse tool providers, e.g. Google reCAPTCHA,

  • entities providing technical, organizational, and administrative services on our behalf,

  • public authorities, if disclosure is required by law.

In relation to Meta and Google functionalities, data may be transferred to entities within the Meta or Google groups, in accordance with the operation of their services and applicable laws.

V. Transfers outside the EEA

In connection with the use of technological, advertising, analytics, and social login providers, your personal data may be transferred outside the European Economic Area, in particular to the United States.

Such transfers take place only on the basis of appropriate legal grounds and safeguards required by applicable law, in particular standard contractual clauses approved by the European Commission or other lawful mechanisms.

VI. Data security

We apply appropriate technical and organizational measures aimed at protecting personal data against loss, destruction, unauthorized disclosure, unauthorized access, or any other unlawful processing.

Connections related to registration, login, and use of the service are secured with SSL/TLS encryption. We also take actions to monitor security and reduce the risk of incidents.

VII. Data retention period

We retain personal data for as long as necessary to achieve the purposes for which it was collected, including for the duration of the user account, the period of service provision, the time required for settlements, handling claims, fulfilling legal obligations, and for the period required by law.

Data related to content posted in the service, including listings, may be stored for 24 months from the date of expiration or deletion, unless longer storage is justified by applicable law or our legitimate interest.

Attachments sent in messages through the service may be stored for up to 36 months. Data related to cookies and similar technologies is stored for the period corresponding to the lifecycle of those technologies or until deleted by the user, depending on their type.

VIII. User rights

Each data subject has rights under the GDPR and other applicable laws, in particular:

  • the right of access to data,

  • the right to rectification,

  • the right to erasure,

  • the right to restriction of processing,

  • the right to object to processing,

  • the right to data portability,

  • the right to withdraw consent at any time, if processing is based on consent.

Withdrawal of consent does not affect the lawfulness of processing carried out before such withdrawal.

The user also has the right to lodge a complaint with the President of the Personal Data Protection Office.

IX. Deleting data and instructions for requesting deletion

Each user has the right to request deletion of their personal data processed by us, including data processed in connection with Meta or Google integrations, to the extent permitted by applicable law.

In the request, it is recommended to indicate that the request concerns deletion of data processed in connection with Motendo.com and, where applicable, data related to Facebook or Google login or the operation of Meta and Google tools.

After receiving the request, we will take action in accordance with applicable law and inform you of how it has been handled.

X. Cookies, local storage, and similar technologies

We use cookies, local storage, and similar technologies to ensure proper operation of the service, maintain user sessions, remember preferences, analyze traffic, protect against abuse, conduct marketing activities, and measure advertising campaign effectiveness.

Cookies may be used both by us and by trusted technology, advertising, and analytics partners.

Depending on the nature of the technology and applicable laws, the use of selected cookies and marketing tools may require user consent.
